BeerCounter Terms of Use

Effective Date: September 29, 2026

These Terms of Use ("Terms") govern your use of the BeerCounter mobile app, the website beer-counter.com and related services (together, the "Service"), including BeerCounter Premium. BeerCounter (contact details at the bottom of this page) provides the Service. By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Drink Responsibly

BeerCounter is an entertainment app for logging the beers you drink and sharing them with friends. It does not encourage excessive or irresponsible drinking, and nothing in the Service is medical, health or nutritional advice. Leaderboards and achievements are for fun; never drink more to reach a goal. Do not drink and drive, and follow the laws on alcohol where you live. If you are worried about your drinking, please talk to a doctor or a local support service.

3. Your Account

• Give accurate information when you sign up and keep your login details safe. You are responsible for activity on your account.
• One person, one account. Do not share, sell or transfer your account.
• Usernames must not be offensive, discriminatory, misleading or impersonate someone else. We may change or remove usernames that break this rule.
• You can delete your account at any time in the app (Profile → Edit Profile → Delete Account) or as described on our Data Deletion page.

4. Your Content

You keep ownership of the photos, descriptions and other content you add ("Your Content"). You give BeerCounter a worldwide, non-exclusive, royalty-free license to host, store, process, display and share Your Content only as needed to run and improve the Service, for example to show your beers to your friends and on your profile. This license ends when you delete Your Content or your account, except for copies we must keep by law or that remain in backups for a limited time, as described in the Privacy Policy.

You confirm that you have the rights to Your Content and that it does not break the law or these Terms. We may remove content that we reasonably believe breaks these Terms, and we use automated moderation for usernames, descriptions and profile photos.

5. Acceptable Use

You must not:

• Upload offensive, sexual, violent, hateful, discriminatory or illegal content, or content that infringes someone else's rights
• Harass, threaten or bully other users, or share their personal information
• Manipulate beer counts, rankings or achievements, for example with fake photos, multiple accounts or automation
• Use bots, scrapers or other automated means to access the Service
• Reverse engineer, decompile or modify the app, or attempt to access our servers or other users' data without permission
• Interfere with or disrupt the Service or its security
• Use the Service for any illegal purpose, or to promote alcohol to minors

6. Beer Recognition

The app uses automated image recognition, including third-party AI services, to check whether a photo shows a beer. Results can be wrong. A failed check does not mean you broke these Terms, and we do not guarantee that every beer will be recognized. Daily limits and waiting times between beers apply to keep rankings fair.

7. BeerCounter Premium

BeerCounter Premium is an optional paid upgrade. It currently removes ads and unlocks premium features such as beer statistics, history export and the premium badge. The features included are described in the app at the time of purchase. Premium is offered as a one-time lifetime purchase and as auto-renewing subscriptions (for example monthly or yearly), depending on availability in your country.

Payment

Purchases are made through the Apple App Store or Google Play and are charged to your Apple ID or Google account when you confirm the purchase. Prices are shown in the app before you buy and may include local taxes. The store's own terms also apply to your purchase.

Auto-renewing subscriptions

Lifetime purchase

A lifetime purchase gives you Premium for as long as BeerCounter Premium is offered in the app, with no recurring charges.

Restoring purchases and accounts

Premium is linked to your BeerCounter account and to the store account used to buy it. If you reinstall the app or change devices, sign in and use Edit Profile → Restore Purchases. If you restore a purchase while signed in to a different BeerCounter account, Premium moves to that account.

Refunds

Payments are processed by Apple or Google, so refunds are handled under their policies. Request an Apple refund at reportaproblem.apple.com and a Google Play refund in your Google Play order history. Where the law gives you a right to withdraw from a purchase (for example in the EU), you agree that the digital content is made available immediately after purchase, and you acknowledge that you may lose that right once it is provided, as far as the law allows. Nothing in these Terms limits your statutory consumer rights.

Changes to Premium

We may add, change or remove Premium features, for example to improve the app. We will not remove the core benefit you paid for (no ads) during a paid subscription period or for a lifetime purchase while Premium is offered. If we stop offering Premium altogether, we will give reasonable notice in the app.

8. Ads and Third-Party Services

The free version of the app shows ads, provided by Google AdMob. The Service relies on third-party services, such as sign-in providers, app stores, payment and subscription services, hosting and AI providers, which are listed in the Privacy Policy. We are not responsible for third-party websites or services linked from the app, and their own terms apply.

9. Our Intellectual Property

The app, website, BeerCounter name, logo, design, achievements and other materials (excluding Your Content) belong to BeerCounter or its licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, only for personal, non-commercial use and in line with these Terms and the store's usage rules.

10. Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account, or remove content, if you seriously or repeatedly break these Terms, if the law requires it, or to protect other users or the Service. Where reasonable, we will tell you why. If we terminate your account without cause, or because we stop offering the Service, we will refund the unused part of a paid Premium subscription where the store allows it.

11. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that the Service will always be available, error-free or secure, that beer recognition results, counts or rankings will be accurate, or that content will never be lost. Keep your own copies of photos that matter to you.

12. Limitation of Liability

To the extent permitted by law, BeerCounter is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for Premium in the 12 months before the claim, or 20 EUR. These limits do not apply to liability that cannot be limited by law, such as liability for intent or gross negligence, or for death or personal injury caused by our negligence, and they do not affect your statutory consumer rights.

13. Apple App Store Terms

If you downloaded the app from the Apple App Store, the following also applies:

• These Terms are between you and BeerCounter, not Apple. BeerCounter, not Apple, is solely responsible for the app and its content.
• Your license to use the app is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the app.
• If the app does not conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• BeerCounter, not Apple, is responsible for addressing any claims by you or third parties relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims that the app or your use of it infringes their intellectual property rights, BeerCounter, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Serbia. Disputes will be decided by the competent courts in Serbia. If you are a consumer living in the European Union or another country, you also keep the protection of the mandatory laws of your country and may bring a claim in the courts where you live. Before starting a dispute, please contact us so we can try to solve the problem.

15. Changes to These Terms

We may update these Terms, for example when we add features or when the law changes. The effective date at the top shows when they were last changed. We will tell you about significant changes in the app or by email before they apply. If you keep using the Service after the changes apply, you accept the updated Terms. If you do not agree, you can stop using the Service, cancel your subscription and delete your account.

16. General

If any part of these Terms is found invalid, the rest stays in effect. If we do not enforce a right, we do not give it up. You may not transfer your rights under these Terms without our consent; we may transfer ours to a successor of the Service, and we will tell you if that happens.
